Adversarial system

The adversarial system or adversary system is a legal system used in the common law countries where two advocates represent their parties' case or position before an impartial person or group of people, usually a judge or jury, who attempt to determine the truth and pass judgment accordingly. It is in contrast to the inquisitorial system used in some civil law systems (i.e. those deriving from Roman law or the Napoleonic code) where a judge investigates the case.

The adversarial system is the two-sided structure under which criminal trial courts operate, putting the prosecution against the defense.

Examples of use of ACCUSATORIAL
1. The question posed was whether a murderer was more likely to get away with his crime under the French inquisitorial or the English accusatorial system of justice.
2. He said he was trying to investigate the death in a ‘forensic manner‘ and insisted: ‘I wanted to be correct.‘ Earlier Mrs Mitton told Dr Southall: ‘Your action in accusing her of drugging and then murdering M1 by hanging him was inappropriate, added to her distress and was in the circumstance an abuse of your professional position. ‘It had been found you failed to respect Mrs M‘s dignity by reason of the accusatorial and intimidating manner in which you questioned her.‘ Dr Southall was also found guilty of a catalogue of other failings linked to children in his care during the 1'80s and 1''0s.
